1. Agreement to Terms

By accessing or using Promto ("the Platform," "we," "us," or "our") at promto.io, you agree to be bound by these Terms and Conditions. If you do not agree, do not use the Platform. We may update these terms from time to time; continued use after changes constitutes acceptance.

2. Description of the Service

Promto is a visual, social platform where creators publish AI prompts and generated images, and users discover prompts, follow creators, like content, purchase credits, and generate images using those credits. Creators may earn commissions when users purchase credits after engaging with their prompts, under our affiliate program.

3. Account and Eligibility

You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Platform. You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information and update it when it changes. We may suspend or terminate accounts that violate these terms or for other reasons we deem necessary.

4. Acceptable Use

You agree not to use the Platform to:

• Post content that is illegal, harmful, abusive, harassing, defamatory, or infringing on others' rights
• Post or prompt for content that exploits minors or promotes violence, self-harm, or illegal activity
• Impersonate others or misrepresent your affiliation
• Scrape, automate access, or attempt to circumvent security or rate limits without permission
• Interfere with the Platform's operation or other users' use
• Use the service for spam, fraud, or to manipulate likes, follows, or affiliate attribution

We may remove content and suspend or terminate accounts that violate these rules. We are not obligated to monitor all content but may do so at our discretion.

5. Your Content and Licenses

You retain ownership of the content you post (prompts, images, profile information). By posting, you grant Promto a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and distribute your content in connection with operating and promoting the Platform (e.g. in the feed, on profile pages, and in marketing). You represent that you have the rights to grant this license and that your content does not infringe third-party rights.

6. Credits, Subscriptions, and Payments

Image generation on Promto is credit-based. Credits (or subscription plans that include credits) are purchased through our payment provider (Lemon Squeezy). Credit packages, subscription terms, pricing, and availability are subject to change. Once purchased, credits are added to your account and consumed when you generate images.

No refunds. All purchases of credits and subscriptions are final. We do not provide refunds or credits for unused credits, cancelled subscriptions, or dissatisfaction with generated images, except where required by applicable law (e.g. consumer rights in your jurisdiction) or where we expressly agree in writing in a specific case. Chargebacks or payment disputes may result in account suspension.

We do not guarantee uninterrupted availability of the generation service or specific output quality.

7. Affiliate Program (Creators)

Eligible creators may participate in our invite-only affiliate program. Participation is subject to separate affiliate terms and registration with our payment/affiliate partner. Commissions are paid by that partner, not directly by Promto. You may not manipulate attribution (e.g. self-purchases or fake traffic). We and our partner may modify or end the affiliate program or your participation at any time.

8. Intellectual Property

Promto and its branding, design, and technology are owned by us or our licensors. You may not copy, modify, or create derivative works of the Platform (other than your own content) without our written permission. Feedback you provide may be used by us without obligation to you.

9. Disclaimers

The Platform and all content are provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee accuracy, completeness, or suitability of any content or generated images. Use of the Platform and any generated content is at your own risk. AI-generated output may be unpredictable; you are responsible for how you use it and for complying with applicable laws.

10. Limitation of Liability

To the maximum extent permitted by law, Promto and its affiliates, officers, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Platform or any content. Our total liability for any claims related to the Platform shall not exceed the amount you paid us in the twelve (12) months before the claim. Some jurisdictions do not allow these limitations; in such cases, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless Promto and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Platform, your content, or your violation of these terms or any law.

12. Termination

You may stop using the Platform at any time. We may suspend or terminate your access or account for violation of these terms, for legal or operational reasons, or at our discretion. Upon termination, your right to use the Platform ceases. Sections that by their nature should survive (e.g. disclaimers, limitation of liability, indemnification) will survive termination.

13. General

These terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict of law principles. Any dispute shall be resolved in the courts of that jurisdiction, unless we agree otherwise. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a right does not waive that right. These terms constitute the entire agreement between you and Promto regarding the Platform.
